The state regulates insurance policies sold within their borders and the state does want the feds to come in and tell them what to allow in insurance policies sold within their borders.

I can understand the regulations, but I don't see where selling the insurance should require a seperate corporation to be formed in the individual state. This only raises costs.

Does anyone have any links with any cases addressing this issue and the final ruling?

I had a job in Texas and had insurance from BCBS of Illinois and now my wife's job is covered by BCBS of Arkansas. When I had UnitedHeathcare, I don't think they were incorporated in Texas.
